Membership Terms & Conditions

Introduction

In this members’ handbook you will find both our responsibilities to you as well as your responsibilities to us. It helps you to enjoy your visit at David Lloyd Leisure as much as possible. Please keep in mind, that in case you sign up to any of our online facilities or communities, extra terms and conditions may apply.

The language used in this handbook has been carefully selected, it should make the rules and regulations as clear as possible. May you still have any questions, please contact our David Lloyd Leisure team. We are happy to help you.

To make this handbook more user friendly, we have split it into two parts.

Part A – Terms and conditions of the membership

All members, including adults and child members whose membership has been linked to other members, as well as child members whose application form has been signed by a required adult, hold the same terms and conditions.

Part B – Terms and conditions of use

Applicable to all our members and their guests.

The terms and conditions apply at all times, they take priority always, and over anything else- even if a David Lloyd Leisure team member may have informed you differently. This handbook replaces any previous versions.

Definitions that apply to both part A and part B:

Linked member - anyone linked to your membership at David Lloyd Leisure club

We and us/ours - David Lloyd Health & Fitness BV

Your club – the David Lloyd Leisure which you have applied to join, or to which you have been transferred to.

Part A – Terms and conditions of the membership

Definitions that apply only to part A

You – the lead member

1. Membership categories

a. You are entitled to use all the facilities available under your category of membership. Your club will inform you about which facilities are available to you and about when to use them. Certain restrictions may apply to each specific category of membership. We will inform you specifically about these restrictions when you join and become a member or in case you change the category of your membership. For more information, please check our website.

b. It may occur that certain membership categories are not available at all clubs. We have the right to choose taking out specific categories from our program. If this is the case and you are a new or existing member you will become unable to use these categories, unless we choose to put this specific category back into to our program again.

c. In case you would like to introduce your children or grandchildren to our club, you are obliged to link them to your membership. The membership fee is based on their age, and if relevant, will increase corresponding the membership as of the month following each birthday. When a child reaches the age of 18, they will become an independent adult responsible for their own actions and hence the signing of their contract. In case the previous lead member wishes to proceed paying the younger person’s membership, this lead member must also sign the new contract. Besides this we will also need permission or a signature from the parental carer of the child or grandchild. This is essential otherwise the child or grandchild is unable to use the club’s facilities. We have the right to limit the number of children linked to adult memberships.

d. In case you wish your nanny to be able to enter the club you will have to link this person to your membership and pay the applicable payment fee. A nanny linked to an adult membership is not allowed to use the facilities in case this person is not accompanied by the child. This type of membership is not meant for parents or grandparents of the child. The nanny membership is only available when the age of the child is under 12.

e. You as the person who signed the membership agreement are responsible for the membership fee for both yourself and all other members linked to the membership. (both child and adults). You are also responsible for paying any extra charges and fees that linked members must pay for using facilities or services that may not be included in your own membership category. You will remain responsible for all payments until the link to the other member or members will be changed as set in clause A5 ‘Changing your membership’, or until the linked member ends his or her membership in accordance with the procedure at clause A11 ‘Ending your membership’.

f. Membership terms and conditions are applicable to all linked members unless stated elsewise.

g. If you need help from someone using the facilities, in case of disability, you can sign in a buddy as a guest. This buddy does not have to pay a fee but is only to use the facilities to help you.

h. In case a child reaches the age of 18, the lead member to whom the child is linked to is at all times responsible to end the membership (in case they wish to do so) with one month’s notice. If they choose not to do end it, the child will automatically be changed to an adult’s package.

i. We have the right to limit the number of children linked to an adult’s membership.

2. Different membership types and validity

a. Your membership will start on the first day of the initial term and will run until it ends in line with clause A11.1, unless you will end your membership early (see A11.3) or in case it will be cancelled by us (see A12C).

b. You are able to end your membership in accordance with clause A11.1 with at least one month’s notice:

  • During your initial term, an additional fee applies unless you have a valid reason (see A11.3);
  • At the end of your initial term;
  • At any moment you please, after your initial term has ended.

The notice period starts from the date we have received your notice.

2.1 Standard membership

a. Initial or first term means a full 12-month period, starting as of the date of your membership application.

2.2 The 3-month membership

a. Initial or first term means a full 3-month period as of the date of your membership application.

b. In case you apply for this before the 25th of the month, you can switch to a standard membership. However, before we can change your membership into a standard membership, you and those who have also signed your application will have to permission and agree on the new application. Completed months of your membership will be included in your new initial term.

2.3 The 24-month membership

a. ‘Initial term’ means a full 24-month period as of the date of your membership application.

b. At the end of your initial term, you are able to end your membership on a monthly base.

3 Membership and fees

a. Administration fee applies when you join. More information available at your club.

b. Some of the clubs may charge joining fee.

c. In case you may be entitled to a membership reduction, when for instance you work at a particular company, you will have to be able to prove this. We may ask you for up-to-date proof from time time.

d. The amount to be paid as membership fee covers the day you became a member until the first day of the next month.

e. The membership fees be direct debit will be taken from your bank account in the last week prior to the new month for which you have filled out and signed a SEPA form. When you choose for annual payment, you will pay the membership fee at once in advance.

f. When you and anyone linked to your membership will become a member we will have to take your picture to be able to check your identity when you enter our premises.

4 Membership cards

a. You (and anyone linked to you) will receive a membership card. This card allows you to enter the club. We have the right to refuse entrance to members that do not have a membership card.

b. Replacement of your membership card is free of charge, however, when you have had your card replaced several times because of loss or damage, the club may decide to charge a fee.

c. The membership is personal and not transferable to other people. For that reason, you are not allowed to lend your card to other people. To protect our members, we can ask you for a second form of identification, besides the membership card, before we allow you into our club(s).

d. When you misuse your membership card, for example when someone else used your card, we have the right to charge a single fine of €15, - or we may end your membership. See clause A12 ‘Cancelling your membership’.

e. Some clubs allow you to use the membership card as a payment card. For instance, to purchase goods or use services within the club. You are only allowed to do so, in case you pay your membership by direct debit.

5 Changing your membership

a. From time to time we will contact you about your membership, therefore it is important to inform us immediately in case your address, phone number or email changes. In case we are unable to reach you because of you not providing us with the latest proper information, we are not responsible.

b. We realise your needs may change over time, that is why we offer you the possibility of changing your membership category. Please contact your club about this. Within your initial term you are able to change your membership from a 3-month into a 12-month membership.

c. You will have to provide us with evidence that shows you qualify for the new membership category. In case you would like to link another member to your membership we also need this other person’s signature to be able to make the change.

d. When you are linked to another member, either you or the other member can apply to end the link. When a linked member wishes to end his or her membership, this person needs to follow the steps in accordance with clause A11 ’Ending your membership’.

e. If we remove someone from a linked membership, the remaining member will become an individual member. In case the link of two linked members has ended, the two members will both become individual members.

f. If we add an adult person to your membership when you are still within the initial term, your membership will be ended and both you and the linked member will be registered again. A new initial term will then be applicable starting as of the day of registration of the linked person.

g. When you change your membership category, your membership fee will be adjusted to the current advertised fares for new members. You will need to pay the difference in joining fee and membership fee between your old and the new membership. If you pay the membership fee in one single payment and your initial term has ended, we will refund any overpayment you may have, related to the period after the change of the category. We will not refund any previously paid joining fees.

h. Changes in your monthly payment may occur, these monthly payment changes will apply from the first day of the month after the change, when we receive notice before the 20th of the month. In case a linked member (adult or child) has ended the membership, changes of your monthly payment will apply at the end of the linked member’s notice period.

6 Extra charges

a. Extra charges for a limited amount of facilities and services may apply. The current charges will be displayed on the notification board in the specific club or you can find a list available at reception.

b. Regarding costs, official bank holidays are to be considered peak hours. Off-peak membership members will not have access to the club facilities during peak hours (please contact your club for more information).

c. Costs may vary from time to time and from club to club. Please contact the membership team at your club for more details on costs and compensation.

d. If you (or a member linked to you) would like to use these extra facilities and services, and you have not yet paid for it, there is a possibility to pay with your bank debit card.

7 Using other clubs

a. As a paying member you can use any other David Lloyd Leisure club. Conditions may apply, please contact your club.

b. In case you wish to use other David Lloyd Leisure clubs, at least 51% of your visits to our club need to be at your own club. If you use other clubs more than your own club, we have the right to change your membership to the club you visit most. It means your membership fee may change.

c. Children or a nanny named on your membership have the same access rights as you do.

8 Guests

a. If you are over the age of 18, you are allowed to introduce guests. You will have to register these guests at reception where they will be asked to fill out a guest registration form. In the club you and your guests must at all times stay together. You are responsible for your guests to be informed about the rules and also to respect and follow the rules and regulations as named part B ‘Terms and conditions of use’.

b. Your guests must pay the applicable fees for using club facilities, costs may vary per club.

c. Social guests (those who will not use the sports facilities) are entitled to use the Café Bar only. They will not pay any extra charges for this. Social guests are not allowed during peak hours, before 2 pm in the afternoon, on Saturdays, Sundays and bank holidays (please contact your club for more details). Social guests must download a pass before visiting the club. This pass is to be found at the ‘Members Lounge’ at our website www.davidlloyd.nl 

d. At certain clubs restrictions for guests and social guests may apply. This may also include extra charges. Guests are only entitled to use facilities their host member is entitled to use too (in accordance with his or her membership). In case you (or your guest) will not follow and respect the rules mentioned in this handbook or will not follow or respect other rules and regulations we may have verbally informed about, it is not possible to bring in any guest for the period of three months.

e. You may sign in up to three guests at one time.

f. You may introduce the same adult guests up to 6x per year, and no more than twice a month.

9 Transferring to another club

a. It is possible to transfer to another club, membership fee conditions from the other club will apply.

b. When your initial term is competed, you will have the possibility to transfer to another club.

c. Within your initial term you can transfer to another club in case:

  • You are transferred to another location for work, further than 15 km from your club; or
  • You move to a location more than 15 km from your club. You will have to be able to hand over recent proof when asked for; or
  • The membership is from a different category than your current membership

d. If you wish to transfer your membership into a club that has a higher membership fee than your previous one, you will receive an invoice for the extra amount that needs to be paid. This amount will be calculated into a percentage (if you have paid your membership fee at once in advance), or we will raise your monthly payment to the level of your new club (in case of monthly direct debit). If you transfer to a club whose payment fee is less than your previous club, we will refund the difference, recalculated in a percentage (if you have paid your membership fee at once in advance) or we will lower your monthly payment to the level of the membership fee applicable at your new club (in the case of monthly direct debit). The new rate will apply as of the first day of the month following the transfer.

e. In case you will transfer to a club that uses a different membership category, you can mention this at the application form. Terms and conditions of the membership may vary those at your previous club.

10 Suspending (freeze) your membership

a. Once a year you are allowed to suspend your membership (other than after you have given us notice to end your membership) for a period of 2 months up to 9 months.

b. To be able to suspend your membership, you will have to fill out a specific form, you can apply for this at any David Lloyd Club. This form needs to be filled out, signed and handed in before the 25th of the month.

c. In case of linked members to your membership, you are allowed to:

  • Suspend the full membership for both you and all the linked adult members and children. Please note that both you and all the linked adult members must sign the membership suspension form;
  • Suspend the link of child members, they don’t have to sign the membership suspension form;
  • Suspend your membership and the membership of all linked adult membership, but please keep in mind that the membership of any linked children will be included in the suspension too.

d. The suspension will start on the first day of the month following the date on which the signed (by all who need to sign) form has been received by us. This must be before the 25th of the month. Please check and make sure the club has received your membership suspension form, in case we have not received the form (in time), the suspension will not be effective. We therefor urgently advise you to check whether we have properly received the form. Example:  Send your form by recorded delivery (we will have to sign for delivery); or  Hand in the form yourself and ask for a written confirmation or receipt.

e. Once we have received the form, we will send you a written confirmation including the date the suspension will be effective. In case you will not receive a confirmation within 10 days, please contact and inform us immediately.

f. Throughout the suspension period your membership status will change automatically into social member. This means you are no longer entitled to use the sport facilities in any David Lloyd club. May we notice you do use sport facilities in other clubs, your membership will be reactivated with immediate effect and you will still have to pay the extra membership fee.

g. Throughout the suspension time of a membership we will charge every adult 25% of the relevant monthly fee for each month the suspension is effective. Children are excluded from this fee.

h. You can suspend your membership in case you are suffering from a medical condition that results in your inability to use the sport facilities. (pregnancy excluded, but medical complications as a result of your pregnancy are included). You will have to be able to hand us a recent (medical) document as proof. The suspension will start on the first day of the month after we have received both the signed (by all who need to sign) membership suspension form and the document of proof. In case of suspension for medical reason, we will not charge monthly suspension fee. You will not have access to the clubs throughout this period.

i. In case you wish to suspend your membership during your initial term, we will extend the initial term with the total period of your suspension. In case you give notice to end your membership or the membership of a linked member during your suspension, the suspension period will end as of the start of the notice period, unless you end your membership in accordance with A11.3 ‘ Ending your membership early’. If you end the membership in accordance with A11.3, the suspension will continue until the end of your membership.

j. Suspension is not the same as ending your membership.

k. In case of overdue payments, it is not possible to process a suspension, all membership fees need to be paid first, before we can suspend your membership.

l. It is not possible to end your membership when your membership is suspended. When your membership has been activated again, and after you gave us notice in writing to end your membership, we can administer the notice period.

m. A suspension can be activated no earlier than the first of the month, with a minimum of 2 months.

11 Ending your membership

a. If your membership has no linked members, then only you can give notice to end it.

b. In case of linked members to your membership, the following rules apply:

  • When you give notice to end your membership, we will consider this a notice to end both your membership as well as all linked members, unless you inform us otherwise.
  • When a linked member, who also signed the membership application form, gives notice to end the membership, we will consider this a notice to end the full membership including your (lead member), and other linked member. Unless we are informed elsewise by the person who gave notice.
  • When your membership has ended, memberships of all linked persons will be automatically end as well.
  • Individual linked adult members can end their own membership by giving us notice to do so.
  • You can end the membership of individual linked children by giving us notice.

c. The notice period and the restrictions on giving notice within the initial term are in clause A11.1 and A11.2 below.

d. You will have to continue to pay for your membership fee until the membership ends.

e. Your membership will end at the end of your notice period.

f. You no longer have access to clubs after your membership has ended. Linked members will not have access to the club after the membership has ended.

g. As long as there are overdue payments, your membership can not be ended by us. Once all the payments are done, we can administer your notice to end the membership.

11.1 Standard membership and 24-month membership

a. You can end your membership during the initial term by giving us at least one month’s notice. If your notice ends before the end of your initial term, an additional charge applies.

b. If your membership ends within the first year of your initial term the additional charge will be the difference between your membership and the 3-month membership of the same category multiplied by the number of months from the start of your initial term until the end of your notice.

c. In case you have a 24-month membership and your notice ends in the second year of your initial term, the additional charge is the difference between the monthly fee of your type and category of membership and the monthly fee for the standard membership of the same category at your club, multiplied by the number of months as of the start of your initial term to the last day of your notice.

d. In the above sections A11.1b and A11.1c, the applied monthly fees are the monthly fares applicable on the last day of your notice. The number of months as of the start of your initial term until the last day of your notice will be calculated as: number of days x 12 / 365.

e. Your notice must end on or after the end of the 3rd month of your initial term. Which means your minimum membership commitment is at least plus additional charge as stated in A11.1a tm A11.1d. After your initial term has ended, you can end your membership at any moment you please by giving us at least one month’s notice. David Lloyd makes use of the actual applicable month plus 1 month. The notice period starts the day after we have received your notice.

11.2 3-month membership

a. You can end your membership during the initial term, by giving us at least one month’s notice. Your notice must end on the last day of the initial term, which means you are committed to pay for the first 3 months of your membership (as well as the days as stated in clause A3d.)

b. After your initial term has ended you can end your membership at any time you please by giving us at least one month’s notice. David Lloyd makes use of the actual applicable month plus 1 month. The notice period starts the day after we have received your notice.

11.3 Ending your membership early a. You can end your membership at all times, if:

  • You are suffering from a long-term medical condition, which results in your inability to use the club’s sport facilities (pregnancy excluded, medical complications as a result of the pregnancy are included)
  • In case you lose your job or when you have gone bankrupt and have an official proof of it
  • You move to a location more than 15 km from a David Lloyd Leisure club; or
  • When it is no longer useful for you to use our club facilities, this only applies when we are convinced there has been a change in your private circumstances (other than listed above) that makes it no longer reasonable for you to stay a member. For this you must be able to give us proof if needed.

b. In case you wish to end your membership using one of the above listed reasons, you must give notice before the 25th of the month. Your membership will end on the last day of the month, of which we have received both your notice and the suitable proof.

c. You must be able to provide us suitable proof to make use of one of the above listed reasons. You must proof to us you can use one of the above-mentioned reasons. Proof may be given to us later than the notice, in case you and the club agreed on this.

11.4 Increase of membership fees

a. You can end your membership at any time in case we give notice- as under A14 (‘Changing your membership fees and this agreement”)- of an increase in your membership fee of more than either 1% above the rate of inflation or 3% (whichever is higher). David Lloyd makes use of the actual applicable month that you are in plus one month extra as a notice. The rate of inflation is the CBS published price index number of July, prior to the date you receive our notice.

b. You will have to give at least one month’s notice in line with A19 (‘Notice’)

11.5 Significant changes at your club

a. You can end your membership or transfer to another club or at all times in case we intend to:

  • Change the location of your club; or
  • Close your club permanently; or
  • Close the indoor swimming pool or the fitness area of your club permanently; or
  • (for racquet sports members) close down all squash- and /or tennis facilities of your club;

b. In all cases a month’s notice applies as in A19 (‘Notice).

c. We endeavour to inform you at least one month prior to any changes or closure (in writing or as an announcement on the memo board in the club). Clause A9a, b, c and A9d do not apply in case you wish a transfer to another club. In case we are not able to inform you about coming changes and or closure on time, you can end your membership by giving us notice. The membership will then end on the date the change will be effective. We will refund any overpayments for the period after that specific date.

12 Cancelling your membership

a. We will not tolerate our staff or other members to be verbally abused, intimidated or for them to get physical threats. When we think this does happen we have the right to exclude you from the club (and any David Lloyd Lleisure clubs) with immediate effect.

b. We are entitled to cancel your membership in the following cases:

  • If you (or one of the linked members) defile the membership agreement or in case you (or one of the linked members) repeatedly misbehave and do not respect and break the club rules and you are unable to make it right after we have asked you to do so and informed you in writing.
  • In case someone else uses your membership card to enter the club and you are aware of this or in case you have given your permission to do so.
  • In case someone else uses a linked members’ card to enter the club, and this linked member is aware of this or has given permission to do so.
  • If you (or your guest or linked member) use obscene, insulting or rude language, in case you (or your guest) misbehave and or use violent behaviour in a David Lloyd Leisure club.

c. If we receive a complaint about your behaviour in this or another David Lloyd Leisure club or in case you persistently behave inappropriate, we have the right to suspend your membership and to start a legal procedure (unless your behaviour is righteous by clause A12a, A12b or A12c of these conditions) Our legal procedures are available to check at our head office or at one of the David Lloyd Lleisure clubs. In case we are unable to solve the issue in line with our legal procedure we have the right to cancel your membership.

d. In case of cancellation of the membership in accordance with any of the reasons mentioned in clause A12a to A12d, we have the right to keep a part of the payment that you have done in accordance to this agreement to cover any costs we may have had to make. Also, we will no longer accept any of your future applications for a membership at David Lloyd Leisure clubs, and all access to David Lloyd Leisure clubs will be refused to you.

e. In case of cancellation within the initial term you are obliged to continue to pay your membership fee until the initial term has ended.

13 Overdue payments

a. If you do not pay the membership fee when it is due, you will receive a first payment reminder requesting you to pay the amount due within 14 days following the date of the payment reminder. In case you are paying by direct debit, and we have not yet received the amount due after the 14-day period we will try to clear the payment with your account later that month. If this is not successful and your direct debit is still relevant we will try to take the payment together with next month’s payment that following month. May this still not succeed you will receive a second payment reminder from us, either in writing or email. This second reminder consists of the total amount due, it also includes a reminder to pay the full amount within 14 days following the date of the second payment reminder.

b. If you still fail to pay (as mentioned in section 13a) we will, without notice, administer a debt collection agency to collect the overdue payments. This includes future payments in accordance with our agreement. (for instance, payments for the rest of the initial term or notice period). The non-judicial collection costs (€40, - minimum, in accordance with the “decree for non-judicial collection costs (“besluit vergoeding voor buitengerechtelijke incassokosten”), as well as the interest on every payment due will be at your expense.

c. If you do not pay your membership fee, we will refuse entrance to the club to you and / or any linked members (both adults and children). This does not automatically include us to cancel and stop your membership.

d. Cancellation of your direct debit does not automatically mean you have given notice to end your membership. If you wish to do so you should always give notice to end your membership in writing, as in clause A11.

14 Changing membership fees, facilities and this agreement

a. We are entitled to increase membership fees automatically with a maximum of 1% above the rate of inflation or 3% (whichever is higher). The rate of inflation is the CBS published price index number of July, prior to the date you receive our notice. In case we decide to do so, your new fee will be valid as of January 1st of the next year.

b. If we plan increase of the membership fee we will inform you with at least 1 months’ notice. We will inform you in writing as indicated in clause A5a or by memo on our notification board in the club.

c. Besides increase as in clause A14a, we always have the right to increase the membership fees in case of (coming) VAT-increase. We endeavour to inform you with at least 1 months’ notice (in writing or by memo on our notification board in the club).

d. We may at all times change these rules as long as we keep you informed about these changes, if we have to make an important change in opening hours or available facilities we will inform you with one month’s notice.

e. We have the right to enhance, reduce or permanently close certain facilities, services and activities in our club. (for example, for maintenance, cleaning or safety reasons). We will inform you beforehand if possible, please see our notification boards.

f. In case your club will be closed for more than 7 days in a row, we will offer you a different facility in our club or at a maximum of 15 km from your club (this might be a facility with less space or services or a temporary space). We will refund a percentage of your membership fee for the time the club was closed, excluding the first 7 days. This does not apply when facilities close permanently or in case we cannot avoid such closure (seasonal facilities such as outdoor pools and courts).

g. If, beyond our control, we are forced to close clubs’ facilities, we will do our utmost best to offer you an alternative or we may a suitable form of compensation.

h. Details of opening hours will available at reception, these may vary during holiday periods. Details will be displayed on our notification boards. May we decide to shorten opening hours, we will inform you with at least one month’s notice.

15 Complaints

a. With the services we offer you we endeavour our members to be satisfied. However, realistically things do not always go as we wish or according to plan. In case you (or your guests) have a complaint, please let us know as soon as possible to give us the opportunity to investigate thoroughly and sort it to the best we can.

b. May you have a complaint, you should always inform one of the staff members at first. If you are not satisfied with his or her action, then please contact the Manager on duty at the club. If you are not yet satisfied you should contact the General Manager of the club. In case the issue is still not solved properly, and you are not yet satisfied you can send a letter to the Regional Director of the club at our head office.

16 Liability

a. We do not accept any liability for damage or loss to your belongings or your guests’ belongings. Unless such damage is the result of our failure.

b. We do not accept any liability for physical injury or death of a member, child or guest inside the David Lloyd Leisure club or on the clubs’ premises. This excludes liability caused by our failure.

c. None of the information in these terms and conditions is meant to restrict or limit any rights you may have as a consumer.

17 Data protection

a. We follow the Data Protection Act (Wet bescherming persoonsgegevens)

b. We deal with all the information we hold on you with care and in accordance with our privacy policy. A copy is available at our website www.davidlloyd.nl or you can get one at your David Lloyd Leisure club. In case you would like us to inform you about the specific data we hold on you, or if you would like to make a correction in the information, then please carefully read our procedures in our privacy policy.

18 Children

a. We welcome children in our club, but please follow the club’s rules and regulations. They should never jeopardize themselves or other people. They should not prevent other people from enjoying our club. In case of misbehaviour we have the right to inform the child and to talk about this with the child.

b. If a child continues to misbehave during one single visit at the club or during a number of visits, we will try and solve the issue by talking to the child’s parents or caretaker. If these conversations will not lead to a proper solution we have the right to suspend the child from our club (and any other David Lloyd Leisure club).

c. If we suspend your child and you wish to appeal, you can do so in writing to the Regional Director of your club at our head office.

19 To give notice

a. You can give notice in writing (addressed to the membership administration of your club). We also accept emails (you can find the email address on our website). When we request specific papers or documents you can add these as an attachment to the email.

b. Your notice will only be administered in case we have properly received it. We suggest sending your notice carefully. For example: Send your notice by recorded delivery (we will have to sign for delivery); or

  • Hand in the form yourself and ask for a written confirmation or receipt
  • Send your notice by email and ask for a confirmation.

c. Within 10 days you should get a confirmation we received your notice. In case you did not receive a confirmation within 10 days, please contact and inform us immediately so we can check if something went wrong.

d. All our communication will be sent to the (email) address we have in our administration system.

Part B – Terms and conditions of use

You – anybody making use of our club facilities under your membership. (including your guests)

1 Health and safety

a. As your safety is our main priority we do not allow tableware such as plates and glasses outside the club room, unless we have organised an activity for which we allow you to do so.

b. Pets (excluding registered assistance dogs) are not allowed in the club.

c. You should respect and follow all the health and safety rules, so the health and safety of all members and guests can be guaranteed. In case you don’t understand instructions or rules, please ask one of our team members for explanation.

d. The emergency exits are indicated clearly. In case of a fire or fire alert your will have to leave the building via the closest possible emergency exit and gather at a specific marked collection point at the parking lot.

e. In case, in our premises, you are involved in an accident or you are injured yourself, you must always report and inform the senior manager on duty about the details of the incident.

f. For legal and health reasons smoking while using facilities and smoking in the club is prohibited.

g. You are expected to behave appropriate, respectful and polite. We also expect you to dress appropriate (for example: no swimsuit in the Club Room). When we are convinced your behaviour is inappropriate or when we think that your appearance is not suitable for our club or in line with our policy, we are entitled to refuse entrance, or we may ask you to leave the club.

h. In case of contagious disease or infection you should not use the club.

i. For your own safety always wear appropriate and decent footwear, suitable for the activity that you are planning to do. (for example, footwear that does not leave any rubber sole shoe marks at synthetic grass tennis courts).

2 Health and safety rules for your children

a. Children 11 years of age and under must at all times be supervised by an adult member (18 years or over), even when they are in a kids’ play area. This excludes children that are joining an organised activity by the club that does not involve parents (supervised activity). In clubs that do not have family changing rooms available children over the age of 8 can use changing rooms without supervision.

b. In case you are not able to bring your children to a supervised activity yourself, a close family member can also bring the child to the activity. This family member does need a card registered on his or her name (apply for this at the General Manager). This person is not allowed to use any facilities except for the Club Room.

c. In case a child takes part in a supervised activity, this child needs to be registered at the activity’s supervisor. This supervisor will need information on who will pick up the child when the activity ends. We do not allow someone else to pick up the child, unless we are specifically informed by you and we made a clear understanding on who will be responsible for picking up the child.

d. Some of the clubs have a crèche for kids as of 3 months up to (and including) 5 years old. You make a reservation for a maximum of 2 hours per session. At least one parent or guardian must always stay at the David Lloyd premises while your child is in the crèche. You are responsible to provide diapers, food, drinks and toiletries for the child.

e. All our crèche staff hold a VOG declaration (legal document of good behaviour), given by the local public institution.

f. Parents or adult carers have to fill in a registration form for all children who use kids’ facilities or in case they will take part in a kid’s activity beforehand.

g. Children who have a contagious disease or infection are not allowed to use the club or crèche.

h. Children as of the age of 8 are allowed to use the men’s or women’s changing room according to their sex (or family changing room if available).

i. Children aged 15 and under are not allowed to use the sauna, steam room or spa.

j. Children aged 13 and under can only use the gym when there is an organised activity for children.

k. Children aged 17 and under, are not allowed to use the solarium.

l. Children aged 13 up to (and including) 16 are not allowed to use the equipment designed to develop muscle strength, and they should always be supervised.

m. Children aged 18 and under who wish to enter the club as a guest should always be supervised by a parent or carer.

3 Parking area

a. You can only use the parking when you visit the club (in case the club has a parking). You can park in the marked parking spaces only. Vehicles of people not using our facilities, vehicles parked outside the marked parking space, vehicles of people who illegally use the parking space for disabled people (when they don’t have a special card) run the risk of getting a wheel clamp.

b. Some clubs have allocated parking spaces available from 9 am to 6 pm for parents with children.

c. Clubs that have a parking garage in the building are excluded from the above-mentioned rules. In case you wish to use this parking garage, extra charges apply.

d. We cannot guarantee availability of parking spaces.

e. Parking is at own risk, we are not liable to loss, car damage or damage to your personal belongings.

4 Swimming pool, sauna, spa and steam room

This article has been written in association with the Royal Life Saving Society.

a. For health and hygiene reason, you and your children must always make sure you shower and use the toilet before using the pool, sauna or steam room.

b. You should always follow set rules and regulations of the pool, spa, sauna and steam room displayed in the club. Make sure you always follow the instructions of the life guards and management.

c. At certain times we may reserve the pool for adult-swimming lessons, aqua-aerobics, swimming lessons and or other activities for children. We will do our utmost best to inform you about these sessions. Please see notification boards.

d. Objects (such as inflatable items) that keep other members from enjoying our facilities will only be allowed at set hours.

e. Snorkels, goggles, fins, flippers, radio’s and lilo’s are not allowed in the club’s pool.

f. The use of mobile phones and cameras is prohibited. Shaving, scrubbing (remove dead skin), and the use of skin oil and conditioners is prohibited too. We will not allow you to take food into the pool, spa, steam room or sauna.

g. Children of 3 and under must wear swimming nappies.

h. Children aged 11 and under using the pool and or pool area must be accompanied or supervised by an adult, a life guard should also be present.

i. Children of 15 years and under are not allowed to use the pool and pool area during set adult-only swimming times.

j. An adult is not allowed to supervise more than 3 children at once.

k. Unless there is a lifeguard present, it is not allowed to instruct or give swimming lessons to children in the pool.

l. You should always bring and use a towel and wear swimwear in the sauna and steam room.

m. Children are not allowed to use the pool after 8pm.

n. Never use the sauna for longer than the recommended time.

5 Lockers

a. All your personal belongings that you take to the club, you take at your own risk. We are not responsible for any loss or damage to your personal belongings.

b. In case you lose a padlock, and the locker is rented in your name, the replacement of these items is at your expense.

c. We have the right to remove the content of a locker that has been in use for more than 24 hours and for which no yearly rental fee has been paid. You can claim your removed personal belongings from this locker within two weeks at reception. After this period, we are no longer responsible for the items and may not be able to return these.

d. May you find any lost items, you should hand it in at the club reception as soon as possible. On our club’s notification board, you can find more information on how and when to collect lost items at reception. We keep these for 3 weeks after this period we will give them to charity.

e. Charges may apply for renting a padlock and or towel. Prices may vary per club, we will ask you to give us your membership card as a deposit.

6 Gym and fitness facilities

Our aim is to make everybody feel good and we try to make this possible as much as we can. We know nobody is the same, everybody has different expectations, a different level of skills, different tolerance and different fitness. But every moment you will spend with one of our coaches is specifically focussed on your needs.

a. Before you start using the gym or fitness equipment, we ask you to fill out a questionnaire about your health and fitness, we also ask you to have a supervised induction lesson with one of our professional qualified fitness coaches.

b. Your exercise schedule will be designed by a qualified fitness coach.

c. In case you may have any concerns about your physical condition, you should never do any strong physical activities without getting professional medical advice first.

d. To get the most out of your training, always make sure you do a proper warming up and take time for a proper cooling down as well.

e. Never take part in any physical activities that you may not be fit enough for. You are responsible for your own health and should always monitor your own condition during physical activities. We are not responsible for any injuries or harm that you may suffer from as a result of taking part in physical activities, unless this has been caused by our failure to provide reasonable care.

f. You should always bring and use a towel in the fitness area

g. It is prohibited to make calls by using your mobile phone in the fitness and in the studios.

h. It is prohibited to ‘reserve’ fitness equipment by putting your towel on it.

i. You should inform the general manager, a qualified coach or a member of the membership team about relevant information concerning your physical condition before you take part in any activity. Make sure the information you share is always up date for as long as you are a club member.

j. You are responsible for your own health and physical condition and should at all times monitor this yourself during physical activities. May you have unusual symptoms then always immediately stop the activity and inform a health- and fitness coach or any other staff member.

7 Racket sports

a. Our professional tennis coaches have been certified by KNLTB, a Royal Dutch Tennis Association (Koninklijke Nederlandse Tennis Bond)

8 Bookings

a. The current booking terms and conditions are available at our website www.davidlloyd.nl or you can a copy at any David Lloyd Leisure club on request. These rules are part of your terms and conditions of use and include rules on how and when you can make a booking and on the information we need from you.

We can change our booking terms and conditions from time to time and inform you about these changes. You can ask for a copy of the terms and conditions at all times to check if any changes have been made.
